Sexual harassment at the workplace can silently damage careers, confidence, and dignity. And that is exactly why India introduced an important law in 2013 — the Prevention of Sexual Harassment at Workplace Act, commonly known as the POSH Act. Now, laws alone cannot create safe workplaces. People must understand them, implement them, and enforce them fairly. And that is where Internal Committees, or ICs, play a critical role. Description

Introduction

Workplace sexual harassment is not only a serious legal issue but also a critical workplace culture and employee safety concern. In India, every organization with 10 or more employees is legally required to comply with the provisions of the Prevention of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 — commonly known as the POSH Act.

Under the law, organizations must:

  • Draft and implement a POSH policy,

  • Constitute an Internal Committee (IC),

  • Conduct fair and timely inquiries into complaints, and

  • Submit annual compliance reports.

However, despite these legal responsibilities, many Internal Committee members and HR professionals receive little or no formal practical training. They are often expected to handle highly sensitive complaints, conduct legally compliant inquiries, maintain confidentiality, prepare documentation, and issue reasoned recommendations — all without structured guidance. Poorly conducted inquiries can lead to legal challenges, reputational damage, employee distrust, and financial consequences for organizations.
